Responsibilities of the Retailers

 

Responsibilities of retailers under the deposit system prescribed by the Law on Packaging and Packaging Waste:

  • The retailers of one-way packaging are obliged to take back one-way packaging waste covered by the deposit system and refund deposits;
  • An exemption shall apply to retailers of packaging that conduct trade in shops with a trading area of up to 300 square meters, town and village shops with a trading area of up to sq m, as well as marketplaces, kiosks, petrol stations and public catering establishments. Retailers of one-way packaging that are eligible for this exemption will be able to participate in the deposit system for one-way packaging at their own discretion;
  • Retailers of one-way packaging are obliged to take back all packaging waste under the deposit system and refund deposits, irrespective of whether they sell products in identical packaging;
  • The retailers of packaging shall organise the receipt of refillable packaging and/or one-way packaging waste and refund deposits at trading venues, or nearby sites that are no further than 150 meters away, by setting the same opening hours as at the trading venue;
  • Deposits for the packaging of sold products shall be returned to the consumers of packaging in cash or, upon the request of consumers, they should be allowed to purchase goods or services, or make donations to the beneficiaries cited in the Republic of Lithuania Law on Charity and Sponsorship, of an amount equal to the value of the deposit;
  • Pursuant to the Republic of Lithuania Law on Packaging and Packaging Waste No IX-517, the vendors of packaging that sell products with packaging covered by the deposit system at a trading venue shall indicate the value of the deposit on the price tag;
  • Vendors of packaging that sell products with packaging covered by the deposit system at a trading venue shall provide written information (on a poster of at least A3 dimensions (420 x 297 mm)) about how consumers of packaging can return refillable and one-way packaging waste;
  • One-way packaging waste covered by the deposit system shall be accepted but the deposit not refunded if:
    • the packaging is not labelled with the mark that denotes the application of the deposit system for one-way packaging, or the mark is not clearly visible, making it impossible to identify; and/or;
    • the packaging is not marked with a barcode or the barcode is damaged, making it impossible to identify the manufacturer or importer; and/or;
    • the packaging is not completely empty; and/or;
    • the shape of the packaging is distorted to the extent that technical identification is impossible.
